PHILBERT Foster, the man convicted of murder but spared the noose because he was three days short of his 18th birthday when he committed the crime, has moved one step closer to being a free man.
His fate may be decided this week.
If he is released, Foster, who was a street child at the time of the murder, wants to mentor other youths in an attempt to steer them away from the path he was on.
Following submissions on Friday from his attorney Michelle Solomon in the San Fernando First Assize Court, State attorney Mauriceia Joseph agreed that Foster had made great strides and was deserving of an opportunity to contribute to society but with conditions attached.
Foster, now 29, whose victim was never identified, was convicted in 2002, but benefitted from a 2007 ruling by High Court Judge Gregory Smith, who found that it was illegal for the court to sentence a prisoner to be "detained at the State's pleasure".
