Boy chokes himself, blames California mom who confronted him about bullying her daughter

Delia Garcia-Bratcher’s lawyer said the mother of six confronted the 12-year-old boy about tormenting her daughter, but never touched the child.A California mom accused of choking a 12-year-old boy because she suspected him of bullying her daughter may not have even touched the child inside the child’s elementary school, a new report shows.

Lawyers for Delia Garcia-Bratcher, 30, released a seven-page report that reveals a witness stated the alleged victim choked himself after the encounter at Olivet Charter Elementary School on May 16, the Santa Rosa Press Democrat reported.

A defense investigator spoke to the 10-year-old witness, who claimed he told the principal and a sheriff’s deputy that he saw the boy put both his hands around his neck, leaving red marks he later said were caused by Garcia Bratcher.

But officials didn’t believe the boy’s story, because he was friends with two other witnesses, the paper reported. Delia Garcia-Bratcher’s lawyer said the mother of six confronted the 12-year-old boy inside the school about tormenting her daughter, but never touched the child.

“I find it troubling that police were told, but they still put my client through this horrible ordeal,” the mother’s lawyer, Ben Adams, told the paper.

Garcia-Bratcher faces a felony count of inflicting injury on a child.  Adams has said that the mother of six did confront the boy about tormenting her daughter, but never touched the child.

Christine Cook, an assistant district attorney for Sonoma County, told KNTV that she had received the report, but law enforcement officers were still investigating the incident.
